Estate Litigation & Disputing a Will

Am an eligible person to bring a claim and how long do I have to bring my claim?
These questions depend on the State where proceedings are commenced. However, some of the people who may be entitled to claim include the following people:

- Wife or husband
- Defacto partner
- Former spouse/defacto partner
- Child, stepchild or grandchild
- Financially dependent
- Close relationship

If you are considered to be an eligible person, in Queensland you have 6 months to give notice of your intention to make a claim on the estate and you must commence proceedings within 9 months. There may be grounds to make a claim outside of this time, however, you will need the courts approval. In NSW you have 12 months to provide notice of your intention to make a claim upon the estate.
